The rapid advent of new technologies is dramatically transforming all aspects of our society, and notarial practice is no exception. Although it has no clear legal definition, digital assets (personal data, online accounts, crypto-currencies, etc.) are becoming part of notarial business (see our article on The Digital Dimension of Assets), and this has a direct impact on you as a notary.

This evolution raises complex challenges for you and your customers, requiring a thorough understanding of the legal, tax and technical issues involved. To stay abreast of this ever-changing landscape, it's imperative for you to engage in an ongoing process of training and updating your knowledge.

To help you with this process, we've prepared a list below!

It aims to provide practical advice to help you maintain your digital heritage expertise, so that you can better serve your customers' interests and needs in this area.

6 points to follow

  1. Start at the beginning by discovering the terms and expressions related to digital heritage with the lexicon developed by ADAN (Association pour le Développement des Actifs Numériques - Association for the Development of Digital Assets).
  2. Keep abreast of legislative and technological developments by reading articles published by various legal publishers: Éditions Francis Lefebvre, LexisNexis, Lamyline, etc.
  3. Follow reference sites or blogs on the subject, such as Village Notaire Patrimoine
  4. Monitor publications by institutions(Senate Report) and official bodies(Autorités des marchés financiers - AMF)
  5. Participate in online training or webinars
  6. Participate in the main legal events dealing with these topics: Congrès des Notaires, TechNot', etc.

Finding reliable sources, sorting through the various pieces of information, retaining only what is useful to you, being able to absorb and transform the content to best serve your interests and those of your customers... Keeping a legal watch takes time, but it is essential if you are to keep up to date and respond to your customers' queries on subjects linked to digital assets.

This list is, of course, not exhaustive, but thanks to these different leads, you now have the elements to help you understand this particular ecosystem and follow the regulatory developments associated with this subject!

Solal Tech can also help you by doing the groundwork for you, then providing you with content so that you can train yourself (training courses, webinars, guides) and communicate your expertise to your customers (newsletter with your image and colors!). Click here to find out more.
